PREAMBLE

MF INVESTISSEMENT SAS is a simplified joint-stock company registered with the Trade and Companies Register of Aix-en-Provence under number 904 779 105, with its registered office located at 3959 route des Pinchinats – 13090 Aix-en-Provence – France, with a share capital of €1,000.

Intracommunity VAT number: FR04904779105.

MF INVESTISSEMENT SAS operates a group of furnished tourist accommodations located at:

6 rue Mozart – 06400 Cannes – France

(hereinafter referred to as the “Accommodation”)

as well as the website:

residencesleslucioles.com

(hereinafter referred to as the “Site”).

The Site allows customers to make reservations and access information relating to the services offered by Résidences Les Lucioles.

These General Terms and Conditions of Sale (hereinafter the “GTC”) apply to any person wishing to make a reservation (hereinafter the “Customer”).

These GTC exclusively govern the relationship between Résidences Les Lucioles and the Customer.


ARTICLE 1 – BOOKING CONDITIONS

1.1 – Prior requirements

To make a reservation, the Customer must be at least 18 years old and legally capable of entering into a contract.

Any reservation made with Résidences Les Lucioles implies full and unconditional acceptance of these GTC. The Customer acknowledges having read them carefully and understood their meaning and scope.

1.2 – Specific rules applicable to the Accommodation

Check-in and check-out times

The accommodations are available from 4:00 p.m. on the day of arrival.

They must be vacated no later than 10:00 a.m. on the day of departure.

Any request for early check-in or late check-out is subject to availability and may incur an additional charge.

Number of occupants

At the time of booking, the Customer must indicate the exact number of people who will occupy the accommodation.

If the number of people arriving exceeds the number stated at the time of booking, Résidences Les Lucioles reserves the right to:

  • apply an additional charge;
  • refuse access to the accommodation; or
  • cancel the reservation without refund.

Identity verification

Résidences Les Lucioles reserves the right to request the presentation of a valid identity document upon arrival.

Minors must be accompanied by a parent or legal guardian.

Use of the accommodation

The Customer undertakes to use the accommodation:

  • in accordance with its intended purpose, namely short-term tourist accommodation;
  • with respect for the premises and the neighborhood;
  • without causing noise disturbance or disruption.

The organization of parties, private events, or gatherings likely to disturb neighbors or damage the premises is strictly prohibited.

The Customer is responsible for any damage caused to the accommodation, its equipment, furnishings, or any common area during the stay.

Access to the accommodation is provided through a secure electronic access control system using a QR code, based on the UniFi Access solution by Ubiquiti.

Terms and conditions of access to the accommodation

Before arrival, the Customer receives a personal and secure QR code by email and/or message.

This QR code allows the Customer to unlock access points (entrance door, common areas, accommodation) by presenting it to the designated reader.

The QR code is:

  • strictly personal and non-transferable;
  • valid only for the duration of the booked stay;
  • automatically deactivated at the end of the booking period.

Operation of the system

The Customer must go to the access point and scan the QR code on the designated reader in order to open the door.

Access is only possible during the authorized time slots defined at the time of booking.

The system may include additional security measures (access logs, time limitations, etc.).

Customer responsibility

The Customer is solely responsible for the use of their QR code.

Any fraudulent use, transfer to a third party, or attempt to bypass the system may result in:

  • immediate cancellation of access,
  • without any refund for the stay.

In the event of loss or non-receipt of the QR code, the Customer must immediately contact the property manager.

Security and data protection

The system may record certain access-related data (times, technical identifiers) solely for the purpose of ensuring building security.

Such data is stored securely and accessible only to authorized persons.

Alternative access

In the event of an exceptional technical malfunction, an alternative access solution may be implemented by the property manager.

Equipment

The accommodations are fully furnished and equipped.

The Customer undertakes to use all furniture, appliances, and equipment appropriately and reasonably, in accordance with their intended use.

Any loss, damage, deterioration, misuse, or abnormal use may be charged to the Customer.

Security deposit

A security deposit may be requested before arrival or at check-in, in the form of a bank pre-authorization or by any other method communicated to the Customer.

This security deposit may be used in the event of damage, missing items, exceptional cleaning costs, or any breach of the Customer’s obligations.

It will be returned after inspection of the accommodation, provided that no damage or outstanding sums are due.

If the amount of the damage exceeds the amount of the security deposit, the Customer will be informed and will remain liable for the difference. Where applicable, legal proceedings may be initiated against them.

No smoking

Smoking inside the accommodation is strictly prohibited.

In the event of non-compliance, Résidences Les Lucioles reserves the right to charge cleaning and deodorizing fees, without prejudice to any other damages.

Pets

Pets are not allowed.


ARTICLE 2 – BOOKINGS MADE THROUGH THE SITE

2.1 – Booking process

To make a reservation through the Site, the Customer must follow the online booking process and provide the required information, including:

  • the desired arrival and departure dates;
  • the number of occupants;
  • the requested category or accommodation;
  • the personal information necessary to process the booking;
  • the selected rate.

The Customer may review and modify their choices until final confirmation of the booking.

2.2 – Applicable rates and conditions

The rates offered may include different booking conditions depending on the selected offer.

Flexible rate / Default rate

Under this rate:

  • the reservation must be guaranteed by a valid bank card;
  • cancellation outside event dates is free of charge up to 30 days before the scheduled arrival date;
  • cancellation of stays during event dates is free of charge up to 60 days before the scheduled arrival date;
  • in the event of late cancellation or no-show, the full stay will be charged.

By selecting a specific rate, the Customer expressly acknowledges and accepts the cancellation and payment conditions applicable to that rate.

2.3 – Booking confirmation

At the end of the booking process, the Customer must provide the personal information necessary to process the booking.

The Customer must then confirm acceptance of these GTC.

Depending on the selected rate, the Customer may also be required to make a payment or provide a valid payment guarantee.

Once the booking has been made through the Site, the Customer will receive a confirmation email at the email address provided, summarizing the booking details.

The Customer is solely responsible for the accuracy of the information entered at the time of booking. Résidences Les Lucioles cannot be held liable for errors resulting from incorrect or incomplete information provided by the Customer.

2.4 – Proof of bookings

Unless proven otherwise, the data recorded by Résidences Les Lucioles in connection with a booking made through the Site constitutes proof of the booking, its content, and its conditions.

2.5 – Prohibited use

Any resale, assignment, commercial transfer, fraudulent use, or attempted fraudulent use of a reservation is strictly prohibited.

In the event of fraud or attempted fraud, Résidences Les Lucioles reserves the right to cancel the reservation and seek compensation for any loss suffered.


ARTICLE 3 – PRICES

The prices displayed on the Site are indicated in euros (€).

They are inclusive of all taxes when VAT is applicable. Otherwise, they are stated in accordance with the VAT-exempt regime applicable to furnished tourist accommodation rentals.

Tourist tax, as well as any other local tax applicable to the stay, is added and must be paid by the Customer in accordance with the regulations in force.

Prices may vary in particular depending on:

  • the stay period;
  • the booking date;
  • the duration of the stay;
  • the number of guests;
  • occupancy levels and market demand.

Résidences Les Lucioles reserves the right to modify the prices displayed on the Site at any time. However, bookings are invoiced on the basis of the rates in force at the time the booking is confirmed.


ARTICLE 4 – PAYMENT

The accepted payment methods are those indicated at the time of booking.

Payment may be required in full at the time of booking depending on the selected rate, or the reservation may be guaranteed by bank card before arrival.

All online payments are processed through secure payment systems using encryption protocols that comply with applicable security standards.

Bank card data is not stored by Résidences Les Lucioles on its own systems.

In the event of a payment incident, refusal of bank authorization, fraudulent payment, or incomplete payment, Résidences Les Lucioles reserves the right to suspend or cancel the reservation.


ARTICLE 5 – NO RIGHT OF WITHDRAWAL – CANCELLATION CONDITIONS

In accordance with Article L221-28 of the French Consumer Code, the legal right of withdrawal does not apply to accommodation services provided on a specific date or during a specific period.

Cancellation conditions depend on the rate selected by the Customer at the time of booking.

Flexible rate (default rate on the Site)

Cancellation is free of charge:

  • up to 30 days before the scheduled arrival date, outside event periods;
  • up to 60 days before the scheduled arrival date for stays including event dates.

In the event of cancellation after these deadlines, or in the event of no-show on the scheduled arrival date, the full stay will be charged.


ARTICLE 6 – INTELLECTUAL PROPERTY

The Site and all of its content, including in particular texts, visuals, photographs, logos, trademarks, graphics, layout, and database elements, are protected by intellectual property rights or may be protected by third-party rights.

Access to the Site and use of the services offered do not imply any transfer or license of intellectual property rights of any kind.

Any reproduction, representation, distribution, modification, extraction, reuse, or exploitation, in whole or in part, of the Site or any of its content, without prior written authorization, is strictly prohibited.


ARTICLE 7 – PERSONAL DATA

The personal data collected and processed by Résidences Les Lucioles is handled in accordance with applicable French law and the General Data Protection Regulation.

The personal data collected in connection with bookings is necessary for:

  • processing and managing bookings;
  • communicating with Customers before, during, and after their stay;
  • complying with legal, accounting, and tax obligations;
  • managing customer relations and improving services.

Depending on the information voluntarily provided by the Customer, Résidences Les Lucioles may also process additional data for service personalization purposes.

Personal data is intended exclusively for authorized persons and service providers involved in booking management and operations, subject to appropriate confidentiality and security obligations.

The Customer has the right to access, rectify, erase, restrict, object to, and, where applicable, port their personal data.

These rights may be exercised by contacting Résidences Les Lucioles using the contact details provided above.

If the Customer believes that their rights have not been respected, they may lodge a complaint with the competent supervisory authority, in particular the CNIL.

ARTICLE 8 – LIABILITY

The Customer is solely responsible for their use of the Site, compliance with these GTC, and compliance with all applicable laws and regulations.

The Customer also undertakes to ensure that these GTC are respected by all persons staying with them or visiting the accommodation during the stay.

The Customer is responsible for any damage, deterioration, loss, nuisance, inappropriate behavior, or breach caused by themselves, their companions, guests, visitors, or any person under their responsibility.

Résidences Les Lucioles reserves the right to require any Customer whose behavior is contrary to public order, morality, safety, hygiene, or the peaceful enjoyment of the premises to leave immediately, without refund or compensation.

The Customer remains fully responsible for all booked services as well as any additional costs or damage caused.

Personal belongings

The personal belongings of the Customer, as well as those of any accompanying person or guest, remain under their full responsibility throughout the stay.

Résidences Les Lucioles cannot be held liable in the event of theft, loss, deterioration, or damage affecting such belongings, whether in the accommodation or elsewhere on the premises.


ARTICLE 9 – FORCE MAJEURE

Neither party may be held liable for any failure or delay in the performance of its obligations resulting from a force majeure event as defined by French law and case law.

Force majeure means any event beyond the reasonable control of the parties, unforeseeable at the time the contract was concluded, unavoidable, and whose effects cannot be prevented by appropriate measures.


ARTICLE 10 – CONTACT AND CUSTOMER SERVICE

Any request must include the Customer’s name, stay dates, and, where applicable, the booking reference in order to facilitate processing.


ARTICLE 11 – APPLICABLE LAW – DISPUTES – MEDIATION

These GTC are governed by French law.

In the event of a dispute relating to the interpretation, validity, performance, or termination of these GTC, the Customer and Résidences Les Lucioles shall endeavor to seek an amicable solution as a matter of priority.

Any complaint must first be sent in writing to:

Failing an amicable solution, disputes shall be submitted to the competent French courts, subject to any mandatory legal provisions to the contrary.

In accordance with the French Consumer Code, consumer Customers may also use a consumer mediation scheme under the conditions provided for by the applicable regulations.

The mediator’s contact details may be communicated upon request or added at a later date.
